Terms of Service

1. Acceptance of Terms

By accessing or using ArtLab ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. We reserve the right to update these terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

ArtLab is an AI-powered image generation platform that allows users to create images from text prompts (text-to-image), modify existing images (image-to-image), and generate videos from text descriptions (text-to-video). The Service operates on a credit-based system where users purchase credits to generate content.

3. Account Registration

To use the Service, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Be at least 18 years of age, or have a parent or guardian's permission, to purchase credits
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account use
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these terms.

4. Credit System and Payments

4.1 Credits

• Credits are required to generate images and videos
• Credit packages are available for purchase starting at $4.99
• Credits are non-transferable between accounts
• Credits do not expire as long as your account remains active
• Different generation types consume different amounts of credits
• If a generation fails because of a technical error, its credits are returned to your balance automatically

4.2 Purchases

• All purchases are processed securely by monobank (JSC Universal Bank, Ukraine)
• Prices are displayed in USD; the charge may be converted to UAH at checkout, and your bank may apply its own exchange rate or fees
• You agree to pay all charges at the prices in effect when incurred
• Bonus credits included in packages are promotional and subject to change

4.3 Refunds

4.4 Immediate Delivery and Right of Withdrawal

Credits are digital content delivered to your account as soon as payment is confirmed. By completing a purchase you ask us to deliver them immediately and acknowledge that, where consumer law gives you a right to withdraw from the purchase (for example the 14-day right in the EU and UK), you lose that right once the credits are delivered.

5. Acceptable Use

You agree NOT to use the Service to:

• Generate illegal content or content that violates any laws
• Create content depicting minors in any harmful or inappropriate context
• Generate content that infringes on intellectual property rights
• Create deepfakes or non-consensual intimate imagery of real people
• Generate content promoting violence, hate speech, or discrimination
• Create spam, malware, or phishing content
• Attempt to bypass content moderation or safety filters
• Reverse engineer, decompile, or attempt to extract the AI models
• Use automated scripts or bots without authorization
• Resell or redistribute the Service without permission

6. Content Ownership and Licensing

6.1 Your Content

You retain ownership of the prompts you submit and images you upload. You grant us a license to process this content to provide the Service.

6.2 Generated Content

You own all images you generate using the Service. You may use them for any purpose, including personal and commercial use such as marketing, merchandise, prints, and publications. No attribution is required.

We do not claim ownership of your generated content. However, similar prompts may generate similar images for different users due to the nature of AI models.

6.3 Public Gallery

Images you generate are private by default. If you make an image public, it appears in the community gallery and on its own public page with its prompt, where anyone, including search engines, can view it, and you grant us the right to display it there. You can make it private again at any time.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

8. AI Generation Limitations

You acknowledge that:

• AI-generated content may not always match your expectations
• Generation results can vary even with identical prompts
• We reserve the right to refuse generation of certain content
• Generation times may vary based on demand and complexity
• Credits are consumed when a generation starts, regardless of whether you like the result; they are returned only if the generation fails for technical reasons

9. Intellectual Property

The Service, including its design, features, and underlying technology, is protected by intellectual property laws. The ArtLab name, logo, and branding are our trademarks. You may not use our intellectual property without written permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service, violation of these terms, or infringement of any rights of third parties.

13. Termination

We may terminate or suspend your account at any time for violations of these terms. You may ask us to delete your account at any time by emailing support@art-lab-ai.com. Upon termination:

• Your right to use the Service will immediately cease
• Unused credits will be forfeited
• We may delete your account data after 30 days

14. Governing Law

These terms are governed by the laws of Ukraine, without regard to conflict of law principles. Any disputes shall be resolved by the courts of Ukraine. If you are a consumer, this does not take away the protection given to you by the mandatory laws of the country where you live.
